Drug Trafficking Defense in Springfield

State & Federal Drug Defense Backed by a 20-Attorney Firm

A drug trafficking allegation can threaten your freedom, finances, employment, housing, and professional licenses. The charge and potential consequences depend on the controlled substance, alleged quantity and conduct, prior record, and whether the case proceeds under Missouri or federal law.

We handle drug cases at both levels and promptly review the charging documents, history of any search and seizure, laboratory findings, witness accounts, and recorded communications. This review can clarify your immediate court obligations and the issues likely to shape the case.

Missouri First-Degree & Second-Degree Drug Trafficking Charges

Missouri separates trafficking drugs in the first degree from trafficking drugs in the second degree under Sections 579.065 and 579.068 of the Revised Statutes of Missouri. The laws address different conduct and apply substance-specific quantity thresholds rather than a single definition or penalty for every controlled substance.

As of August 28, 2026, first-degree trafficking generally addresses knowingly distributing, delivering, manufacturing, producing, or attempting to distribute, deliver, manufacture, or produce specified quantities of a controlled substance. Second-degree trafficking generally addresses knowingly possessing, purchasing, attempting to purchase, or bringing specified quantities into Missouri.

The potential felony classification depends on the applicable statutory subsection:

  • First-degree trafficking: The charge may be classified as a Class B or Class A felony based on the substance, alleged quantity, and other statutory circumstances.
  • Second-degree trafficking: The charge may be classified as a Class C, Class B, or Class A felony under the relevant substance and quantity provisions.
  • Missouri sentencing ranges: A Class C felony generally carries three to 10 years, a Class B felony five to 15 years, and a Class A felony 10 to 30 years or life imprisonment.

These ranges aren’t predictions for an individual case. Assessing potential exposure requires reviewing the exact statute, controlled substance quantity, prior offenses, and other applicable charging provisions.

State & Federal Prosecution in Springfield

Federal involvement isn’t automatic. Whether a case proceeds under Missouri or federal law can depend on the alleged activity, where it occurred, the investigating agencies, the evidence, and other jurisdictional facts.

A state case arising in Greene County may proceed in the Greene County Circuit Court. The Southern Division of the U.S. District Court for the Western District of Missouri is based in Springfield, and its boundaries include Greene and Christian counties. Federal prosecution involves different charging practices, discovery procedures, sentencing rules, and deadlines.

We identify which government is investigating or prosecuting the case, assess whether parallel investigations may be underway, and address the procedural demands requiring immediate attention.

Evidence That Can Shape the Defense

Prosecutors may rely on packaging, cash, transportation records, locations, witness statements, communications, and the alleged quantity to argue knowledge or intent. When drugs are found in a shared space, disputes may arise over whether the accused knew about the substance or controlled the place where officers found it.

Our review may address several core issues:

  • Stops, searches, and warrants: Whether officers had a lawful basis for a stop, whether consent was valid, and whether a search warrant was legally sufficient.
  • Laboratory analysis: Whether testing reliably identified the substance and whether weight calculations support the quantity alleged.
  • Chain of custody: How the evidence was documented and handled from seizure through testing and presentation in court.
  • Recordings and reports: Whether body-camera footage, vehicle-camera video, police reports, and witness accounts are accurate and consistent.
  • Knowledge and control: Whether the evidence connects the accused to the substance and proves awareness of its presence.

Possible defenses depend on the evidence and may involve insufficient proof of knowledge, control, or intent; unreliable witnesses or testing; or constitutional violations. If evidence was obtained unlawfully, the defense may ask the court to suppress it.

Resources for a Detailed Criminal Defense Investigation

Lowther Johnson Attorneys at Law, LLC has served Springfield and Southwest Missouri since 1975. With 20 attorneys and experienced support staff, we provide personal attention while drawing on the resources of a broader legal practice.

Depending on the case, our preparation may include interviewing witnesses, reviewing police records, examining an alleged crime scene, and retaining outside professionals to analyze technical evidence. We focus this work on disputed facts, weaknesses or gaps in the prosecution’s evidence, and the decisions the client may face.

How to Prepare for Your Case Evaluation

An initial evaluation should establish what has happened, which court or agency is involved, and what deadlines or appearances are approaching. Bring any available documents, even if the prosecution hasn’t provided complete discovery.

Useful information may include:

  • The complaint, indictment, information, or other charging document
  • Bond conditions, release paperwork, and court-date notices
  • Search-warrant documents, property receipts, and police reports
  • Laboratory reports or descriptions of the substances and quantities alleged
  • Messages or notices received from investigators or prosecutors
  • A clear account of the arrest, traffic stop, search, or questioning

If you’re under investigation, obtain legal advice before discussing the facts with law enforcement or other parties. We can assess the current procedural posture, evidence concerns, possible jurisdiction, and decisions that may arise next.
