Missouri’s Requirements to Qualify for an Uncontested Divorce

Before filing, at least one spouse must have lived in Missouri for the 90 days immediately preceding the petition (RSMo 452.305). Military members stationed in Missouri satisfy this requirement even if their legal domicile is elsewhere. There’s no separate county residency threshold. The petition is filed in the circuit court of the county where either spouse resides once that 90-day mark is met.

For the case to remain uncontested, the spouses’ agreement must be complete. Timeline & Final Hearing

Most uncontested divorces in Missouri finalize within two to three months of filing, depending on the court’s docket. A brief final hearing gives the judge the opportunity to confirm both spouses understand the settlement and that it meets the court’s standards before the dissolution is granted.

Filing in Greene County or Christian County

Where you file depends on where you and your spouse live. Springfield residents generally file with the Greene County Family Court. If you reside in Christian County, your case goes to the Christian County Circuit Court in Ozark, part of the 38th Judicial Circuit. When spouses live in different counties, the petition may be filed in either county’s circuit court, giving couples some flexibility in choosing venue.
